The New York State School Superintendent Handbook 2nd Edition is must reading for School Principals, School Superintendents, Board of Education members, and hearing officers appointed by a superintendent.
New York State Education Law 3214 authorizes a school principal to suspend a student for a maximum of five school days. In the case of a student that violates the Code of Conduct to an extreme such as being in possession of a weapon, controlled subtance, or assault of a staff member the principal can request a fair hearing. Education Law allows a School Superintendent to extend a school suspension beyond five days. A School Superintendent can preside over a hearing or appoint a hearing officer to make a non-biding recommendation. The majority of fair hearings result in an extended suspension that may last weeks, a marking period, a semester, and in some cases a school year.
The New York State School Superintendent Handbook 2nd Edition covers every aspect of the hearing protocol, student "due process" rights, and the requirements when a student is identified as having an educational disability. It even contains a "sample script" that covers all the necessary components and language used in a hearing and can be used as needed.
